Contract Law is one of the fundamental aspects of any legal system,
anywhere in the world. Contracts cover almost every aspect of our
life from playing golf to running a business. Contracts can be worth
a few pounds or many millions of pounds.
It is not surprising therefore that disputes arise in such matters.
The best way to avoid dispute is to have a carefully worded
contract, so that there can be no ambiguity. Even so disputes will
arise and on such occasions the only way to resolve the issue is to
let a court decide.
A considerable amount of the courts time is spent determining
contract disputes. What tends to happen is that the smaller contract
disputes will be decided by the lower civil court - the County
Court, whereas the more complicated and more expensive contract
disputes will be considered by the High Court.
Debt Recovery
If someone is indebted to you but is refusing to pay, the correct
procedure is to issue proceedings at court. The court has certain
powers open to it to make sure that the debtor pays - as far as they
are able.
For example, it is a court who sends the dreaded Bailiff around to
your house or business. The court can also request that you attend
to give evidence on Oath as to all of your incomings and outgoings
and set a figure to pay off the debt every month for example.
What the court cannot do is force a debtor to pay money that he does
not have at any time. This is when such things as bankruptcy
proceedings must be considered.
