“I would like a share of my husband’s pension but I want a clean break from him!”
Many couples who divorce believe that if they claim a share of their former spouses pension they will not be able to have a financial “clean break” and will remain linked to their former spouse for life.
It is not the case that this will always occur.
Depending upon the circumstances, it may be possible for a Court to make a pension sharing order in favour of a spouse. This means that part of the pension belonging to one spouse can be transferred into a pension fund for the other spouse and held in that spouses name. The receiving spouse will then be able to take the pension under the terms of their pension scheme, completely independently of what their former spouse may or may not do in the future.
